1. About PortClear AI

PortClear AI is a product of SeaPorter Operations Pty Ltd (ABN 49 695 521 914), a company registered in Western Australia, Australia. PortClear AI provides an AI-assisted pre-arrival documentation tool designed to help vessel masters, shipping agents, and maritime operators prepare Australian port clearance documents including DAFF Pre-Arrival Reports (PAR), ABF Impending Arrival Notices, and related compliance documentation.

2. Acceptance of terms

By creating an account or using PortClear AI, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. These terms apply to all users including vessel masters, shipping agents, fleet operators, and any other maritime professionals using the platform.

3. Nature of the service — important disclaimer

PortClear AI uses artificial intelligence to assist in the preparation of maritime compliance documentation. You acknowledge and agree that:

  • ·PortClear AI is an assistance tool only and does not replace professional maritime legal advice, the services of a licensed shipping agent, or your obligations under Australian law.
  • ·The vessel master, operator, or their authorised agent remains solely responsible for the accuracy, completeness, and timeliness of all submissions made to DAFF, ABF, MARS, or any other regulatory authority.
  • ·AI-generated content must be reviewed and verified by a qualified person before submission to any government authority.
  • ·Regulations, requirements, and deadlines change frequently. You are responsible for verifying current requirements with DAFF, ABF, and other relevant authorities.
  • ·PortClear AI does not submit documents directly to any government authority on your behalf. You must submit all reports through the official government portals.

4. User responsibilities

As a user of PortClear AI, you agree to:

  • ·Provide accurate and complete vessel and voyage information when using the platform.
  • ·Review all AI-generated documentation before submission to any government authority.
  • ·Maintain the security of your account credentials and not share access with unauthorised persons.
  • ·Comply with all applicable Australian laws and regulations including the Biosecurity Act 2015, Customs Act 1901, and Maritime Transport and Offshore Facilities Security Act 2003.
  • ·Not use PortClear AI for any unlawful purpose or to submit false or misleading information to government authorities.

5. Subscription and payment

PortClear AI offers a free tier with limited usage and paid subscription plans. By subscribing to a paid plan, you agree that:

  • ·Subscription fees are billed monthly in Australian dollars (AUD) inclusive of GST where applicable.
  • ·You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • ·Refunds are assessed on a case-by-case basis. Contact us at hello@portclear.ai to discuss any billing concerns.
  • ·We reserve the right to change pricing with 30 days notice to existing subscribers.

6. Limitation of liability

To the maximum extent permitted by Australian Consumer Law:

  • ·SeaPorter Operations Pty Ltd is not liable for any fines, penalties, vessel detentions, delays, or losses arising from the use of PortClear AI or reliance on AI-generated documentation.
  • ·Our total liability to you for any claim arising from use of PortClear AI is limited to the amount you paid for the service in the 3 months preceding the claim.
  • ·We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

7. Intellectual property

PortClear AI, its software, design, and content are owned by SeaPorter Operations Pty Ltd. You retain ownership of the vessel and voyage data you enter into the platform. By using the service, you grant us a limited licence to process your data for the purpose of providing the service.

8. Termination

We reserve the right to suspend or terminate your account if you breach these terms, use the service for unlawful purposes, or engage in conduct that may harm other users or the integrity of the platform. You may terminate your account at any time by contacting us at hello@portclear.ai.

9. Governing law

These terms are governed by the laws of Western Australia, Australia. Any disputes arising from use of PortClear AI will be subject to the exclusive jurisdiction of the courts of Western Australia. Nothing in these terms limits your rights under the Australian Consumer Law.
